Price, availability & product description

• Prices and availability of goods are subject to change without notice.

• We endeavor to ensure that all pricing shown on Baas House is monitored and accurate. However, errors may occur. If we discover an error in pricing of the products in your order we will inform you as soon as possible using the contact details supplied at checkout. We will then give you the option of reconfirming your order at the correct price or cancelling it. (If we are unable to reach you within 24 hours then we will treat the order as cancelled). If an order is cancelled, any payment made for the products will be refunded in full. The remaining order (if any) will be fulfilled in the usual way in accordance with these Conditions.

• Please note, the prices shown do not include the delivery costs. Delivery will be calculated at checkout.

• Our prices are shown in KSH and are inclusive of VAT at the current rate in the Republic of Kenya.

• Payment for the goods must be made at checkout before any goods are dispatched.

• If goods are being ordered from outside of the Republic of Kenya then Import Duty & Taxes may be incurred once the goods reach their destination- Baa’s House will not be liable for any such duties and taxes.

• We endeavor to keep our stock inventory as up to date as possible. However, there may be an instance whereby a particular product is not available and we cannot fulfill your order. If this instance arises, we will notify you as soon as possible after receiving your order and give you an option to either cancel the order (and receive full refund) or provide an opportunity to choose an alternative / similar product or size. The remaining order (if any) will be fulfilled in the usual way in accordance with these Conditions.

• We have made every effort to display as accurately as possible the colours and images of our product. We cannot guarantee that your computer monitor’s display of any colour will be accurate.

• We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by –case basis. We reserve the right to limit the quantities or cancel quantities purchased of any product or services that we offer per person, per household or per order. These restrictions may include orders placed by or under the same customer account, same payment card, and /or orders that use the same billing and/or shipping address.

• In the event that we do make a change or cancel and order, we may attempt to notify you by contacting the e-mail address and or telephone address provided at checkout.

• We reserve the right to discontinue any product at any time.

• Although we aim to keep the Website as up to date as possible, the information including Product Descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order. If it is important for you to check details with us where you think it does not appear 100% accurate. We will not accept any liability in these circumstances.

 

Delivery

• We reserve the right to merge orders which are being dispatched to the same address. We also reserve the right to dispatch one order in as many separate deliveries as we deem fit. ​

• We aim to dispatch all orders within 3-5 working days following receipt of your order and aim to deliver the products to you within 7 days within the Republic of Kenya in most circumstances. We will not be liable for any loss caused to you by a late delivery. Store pick-ups will be ready on the 5th working day following the order unless agreed otherwise.

• We cannot refund for lost goods until goods are returned or declared lost by the courier services. If an order is declared lost by courier after 2 weeks, we will send a replacement out. This does not affect your statutory rights as a consumer.

• Any dates quoted for delivery are estimated delivery dates only and may be subject to change. We accept no liability for any loss or damage (whether direct or indirect) if delivery takes place at any time other than the estimated date for delivery.

• We recommend that you place any orders with enough lead-time to prevent any loss or disappointment resulting from the delivery time as we cannot be responsible for this.

 

OUR RIGHTS

We reserve the right to:

• modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or

INTERNATIONAL CUSTOMERS
If Goods are being ordered from outside Kenya, import duties and taxes may be incurred once your goods reach their destination.  Baas House is not responsible for these charges and we undertake to make no calculations or estimates in this regard.  If you are buying internationally (anywhere outside Republic of Kenya), you are advised to contact your local customs authorities for further details on costs and procedures.  As the purchaser of the goods, you will also be the importer of record and as such should ensure that your purchase is in full compliance with the laws of the country into which the goods are being imported.  Please be aware that Goods may be inspected on arrival at port for customs purposes and Baas House cannot guarantee that the packaging of your Goods will be free of signs of tampering when it/they reach you.

 

INTELLECTUAL PROPERTY

Contract creation and electronic contacting

The technical steps required to create the contract between you and us are as follows:

• You place the order for your products on the Website by pressing the confirm order button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Website.

• We may send you an order acknowledgement email as soon as you place your order, and you will receive an order confirmation email detailing the Products you have ordered. (These emails do not constitute acceptance of your order).

• For items being delivered to you when your product is shipped from our warehouse we will send you a dispatch confirmation email.

• Order acceptance and the completion of the contract between you and us will take place on the dispatch to you of the Products ordered unless we have notified you that we do not accept your order, or you have cancelled it by letting us know in writing by email or whatsapp before you receive a dispatch note.

 

Non-acceptance of an order may be a result of one of the following:

• The product you ordered being unavailable from stock.

• Our inability to obtain authorisation for your payment.

• The identification of a pricing or product description error.

• The identification of no stock for ordered Products.

• You not meeting the eligibility to order criteria set out in the main Terms & Conditions.

Refunds or exchange

• Our products may have limited quantities and are subject to return or exchange strictly in accordance to our Return Policy.

• We believe that you will be delighted with your products but there may be occasions where you feel it necessary to return an item. We aim to keep the process as simple as possible. These terms do not affect your statutory rights.

• We will try to attend to all returns as soon as practically possible.

• We are unable to accept returns or exchange of any items, which have been used or worn. Moreover, we do not offer any refund or exchange for any items related to religion (Pooja essentials and articles), wedding (Wedding essentials and articles) and decorations and books. Please read our Return Policy for more information.

 

Unwanted Products

• Our policy is to ensure that you are satisfied every time you place an order with us. If you are unhappy with an item when you receive it or if you simply change your mind please return it, with the dispatch note, unused, having taken reasonable care of it and complete with packaging and all components, for a full refund- the return should be made within 7 working days.

• We will make the refund directly to the credit/charge card used to place the original order within 14 days or earlier once we have inspected the returned item and are satisfied that it has been returned to us in the condition it was in when delivered to you.

• We do not refund the cost of the original delivery charge or return postage charge on returned merchandise.​

 

Faulty Products

• We ensure all products are checked and packaged well to ensure they reach you in perfect condition. However, if a product arrives damaged or with defects, or is not what you ordered, we will replace or provide a refund as appropriate. ​You are required to post the item back to us within 7 working days.

• You will be refunded once the item is received by us and fully inspected.

• You must contact us by email on the day of receipt with a photograph and a short description of the damage and you return the product to us within 7 working days.

You will be responsible for the returned products until they reach us.

​This does not affect your Statutory Rights.

Cancellation Policy

• All orders can be cancelled with no charges up until the point the goods have been dispatched.

 

Purchase made during a sale  

• If an item is bought during a sale, and a refund is later required for whichever reason on this item you will be refunded the sale price only for a return that is accepted by us.
